The practice of paying prisoners to for their participation in research has long been debated, and the controversy is reflected in the differing policies in the U.S. prison systems. Empirical study of financial payments to inmates who enroll in research has focused on whether this practice is coercive. In this study, we examined whether monetary incentives have the potential to be unduly influential among fifty HIV‐positive prisoners. The majority of prisoners surveyed believed that inmates should receive some compensation for their (...) involvement in research and disagreed with statements suggesting that the offer of payment constitutes undue influence. However, a sense of potentially being susceptible to undue influence was significantly higher among participants who had spent a longer time in prison and had less education. Overall, our findings suggest that most prisoners feel that they would be able to make a decision about research enrollment that is not solely based on an offer of monetary payment. (shrink)

Several scholars have recognized the limitations of theories of moral reasoning in explaining moral behavior. They have argued that moral behavior may also be influenced by moral identity, or how central morality is to one’s sense of self. This idea has been supported by findings that people who exemplify moral behavior tend to place more importance on moral traits when defining their self-concepts (Colby & Damon, 1995). This paper takes the next step of examining individual variation in a construct highly (...) associated with immoral behavior — psychopathy. In Study 1, we test the hypothesis that individuals with a greater degree of psychopathic traits have a weaker moral identity. Within a large online sample, we found that individuals who scored higher on a measure of psychopathic traits were less likely to base their self-concepts on moral traits. In Study 2, we test whether this reduced sense of moral identity can be attributed to differences in moral judgment, which is another factor that could influence immoral behavior. Our results indicated that the reduced sense of moral identity among more psychopathic individuals was independent of variation in moral judgment. These results suggest that individuals with psychopathic traits may display immoral behavior partially because they do not construe their personal identities in moral terms. (shrink)

White matter tracts are known to be susceptible to injury following concussion. The objective of this study was to determine whether contact play in sport could alter white matter metabolite levels in female varsity athletes independent of changes induced by long-term exercise. Metabolite levels were measured by single voxel proton magnetic resonance spectroscopy in the prefrontal white matter at the beginning and end of season in contact and non-contact varsity athletes. Sedentary women were scanned once, at a time equivalent to (...) the Off-Season time point. Metabolite levels in non-contact athletes did not change over a season of play, or differ from age matched sedentary women except that non-contact athletes had a slightly lower myo-inositol level. The contact athletes had lower levels of myo-inositol and glutamate, and higher levels of glutamine compared to both sedentary women and non-contact athletes. Lower levels of myo-inositol in non-contact athletes compared to sedentary women indicates long-term exercise may alter glial cell profiles in these athletes. The metabolite differences observed between contact and non-contact athletes suggest that non-contact athletes should not be used as controls in studies of concussion in high-impact sports because repetitive impacts from physical contact can alter white matter metabolite level profiles. It is imperative to use athletes engaged in the same contact sport as controls to ensure a matched metabolite profile at baseline. (shrink)

This study aims to reveal patterns of e-petition co-signing behavior that are indicative of the political mobilization of online “communities”. We discuss the case of We the People, a US national experiment in the use of social media technology to enable users to propose and solicit support for policy suggestions to the White House. We apply Baumgartner and Jones's work on agenda setting and punctuated equilibrium, which suggests that policy issues may lie dormant for periods of time until some event (...) triggers attention from the media, interest groups, and elected representatives. In the case study presented, we focus on 21 petitions initiated during the week after the Sandy Hook shooting in opposition to gun control or in support of policy proposals that are alternatives to gun control, which we view as mobilized efforts to maintain stability and equilibrium in a policy system threatening to change. Using market basket analysis and social network analysis we found a core group of petitions in the “support law-abiding gun owners” theme that were highly connected and four “communities” of e-petitioners mobilizing in opposition to change in gun control policies and in favor of alternative proposals. John Martin Fischer is one of the leading proponents of semi-compatibilism, one of the ideas proposed in the debates on free will and determinism. According to him, even if it is not possible to make a free choice once determinism is accepted, persons can be held morally responsible for their actions. Thus, the ability to choose one of several alternatives, i.e. to act otherwise, is not necessary for moral responsibility. This essay seeks to shed light on the connections between elevated isnād and al-sābiq wa’l-lāhiq (distance between the first and last narrator of traditionist). Since the 2nd/8th century, when the search for elevated isnāds began, intense interest has been seen by the traditionists. The article looks at how these initiatives to elevated isnād helped pave the way for the emergence of al-sābiq wa’l-lāhiq. Similarly, it is investigated if al-sābiq wa’l-lāhiq promotes the look for elevated isnād. First, the data documentation approach (...) was applied to data taken from the history of hadith, various hadith techniques, and biographical dictionaries to ascertain the relationship between two notions. The relationship between two themes is then made clear using information from Khatīb Baghdādī’s (d. 463/1071) al-Sābiq wa’l-lāhiq, the first work authored in this field. Significance of the study of Khatīb Baghdādī’s work is further increased by the fact that he was the first to present the idea. The relationship between the subjects has been looked at in the article from three different theoretical angles. First, historical information has been used to assess how the orientation of hadiths concerning elevated isnād created the stage for the conception of al-sābiq wa’l-lāhiq. Then, the connection between subjects was examined through explanations of hadith methodology and biographical dictionaries authors. When the historical records of hadiths are reviewed, it becomes clear that the traditionist supported the hearing of elevated isnād and its transmission starting in the 2nd/8th century, particularly in the 3rd/9th and 4th/10th centuries. al-Sābiq wa’l-lāhiq was founded as a consequence of factors including the existence of grandfathers and grandchildren who reported from a single hadith due to orientation in elevated isnād and the fact that certain traditionists took pride in passing down the narrations of the elders to the younger generations. In addition, as the century moved away from the Prophet, the elevated isnāds that enable to reach him with a short isnād gained more importance. This situation explains why al-sābiq wa’l-lāhiq was formed in the 5th/11th century. It was also discovered that Khatīb Baghdādī’s introduction of this idea to the discussion was not a coincidence, and it was stated that this was due to his interest in elevated isnād. The connection established by the authors of hadith methodology between two concepts is that al-sābiq wa’l-lāhiq encourages the audition of elevated isnād. al-Lāhiq in other words hadith aspirants who want to be the last person who transmits hadith from a traditionist, that is, turning to mu‘ammerūn (long-lived) teachers at a young age supports the audition of elevated isnād. The efforts of biographical dictionaries authors to record elevated isnads that reached al-lāhiq were evaluated as a different manifestation of this situation. The connection between two subjects has also been examined in the work of Khatīb Baghdādī, which has the same name as the concept and various findings were obtained about al-sābiq wa’l-lāhiq and traditionists who were attributed to him as al-sābiq wa’l-lāhiq. According to this, it has been understood that traditionists who were compared to al-sābiq wa’l-lāhiq were chosen from among the long-lived people. A study was conducted on 6 traditionists, in whom Khatīb determined the ratio of al-sābiq wa’l-lāhiq to 10 or more. According to this, it has been determined that the narrators, who are mentioned as al-sābiq, are generally attributed to teachers or peers of traditionists. However, it has been revealed that there is no obligation to be a teacher or peer, and sometimes there are al-sābiqs among the students. The fact that most of the al-sābiqs are teachers and peers shows that the concept is considered a rarity. Because in the history of hadith, isnād generally goes from student to teacher. In addition, the narration of peers from each other or the teacher from students showed that narrators, who are called al-sābiq, have descending isnāds from that teacher. However, it has been determined that not all the narrations of al-sābiq were descending, only of whose narrations from that traditionist would be regarded as descending. As al-lāhiq, on the other hand, is the last person to transmit hadith from traditionist, he already has elevated isnād and all of them are long-lived people. However, the missing part of Khatīb’s book is that he does not pay attention to whether al-lāhiq is reliable or abandoned. In addition, it was stated that al-lāhiq should be chosen only from reliable, and in this case, it would not affect the distance between al-sābiq and al-lāhiq. (shrink)

Bu çalışmanın amacı İbn Kesîr’in (öl. 774/1373) el-Bidâye ve’n-nihâye isimli tarih çalışmasının siyer bölümünde Sahîhayn hadislerini muhteva açısından tenkidinin araştırılması ve tahlilidir. Çalışmamızın konusu ise İbn Kesîr’in mezkûr eserinde yirmi Sahihayn hadisini Kur’ân-ı Kerîm (3 hadis), akıl (1 hadis), icmâ (1 hadis), sahih hadisler (7 hadis) ve sağlam târihî bilgilere (8 hadis) uygunluk/aykırılık kıstaslarını kullanarak tenkidi ve on dört hadiste izah getiremediği yanlışların birer hata olduğunu kaydetmesidir. İbn Kesîr’in incelenen hadislerin muhteva tenkidine müsait bir hâle gelmesine yol açan râvi tasarruflarına (...) dair verdiği bilgiler ayrıca kıymetlidir. Bu çalışmanın kapsamını oluşturan hadislerden yedi tanesi hem Sahîh-i Buhârî hem Sahîh-i Müslim, altı tanesi sadece Sahîh-i Buhârî, yedi tanesi de sadece Sahîh-i Müslim’de yer almaktadır. Hem Sahîh-i Buhârî hem Sahîh-i Müslim’de yer alan hadisler Hayber’de müt‘a nikahının yasaklanışı, Rasulullah’ın (s.a.v.) umre ve hacca niyeti, Hz. Peygamber’in gümüş yüzüğü atması, kıblenin değişimi haberinin Kubâ’ya ertesi sabah ulaşması, namazda konuşma yasağının zamanı, ye’cûc ve me’cûc’un seddinin delinmesi ve Hz. Araştırmamızın yöntemi kaynak taraması ve sonuçların diğer şarihlerinkiyle mukayeseli tahlilidir. Araştırmamızın sonucunda eleştirilen hadislerin büyük bir kısmında İbn Kesîr’in değerlendirmelerinin İbn Hacer ve Nevevî gibi muhaddislerinkinden farklı olduğu görülmüştür. Çalışmamızın önemi İbn Kesîr’in tenkitlerinin muhaddislerin senedin sıhhatinin metnin sıhhatini temin etmeyeceğine dair tespitlerinin uygulamadaki somut delillerini oluşturmasıdır. Kısaca İbn Kesîr’in, eserine güçlü tenkit zihniyetini, özgün görüşlerini ve geniş ilmî birikimini başarıyla yansıttığı görülmektedir. (shrink)

Hz. Peygamber’in ashâbı, bir takım şahsî özellikleri açısından hadis rivayetine farklı şekillerde katkı sunmuşlardır. Bu çalışmada da Yahudilikten ihtidâ etmiş bir sahâbî olması özelliğiyle dikkatleri çeken Abdullah b. Selâm ve hadis rivayeti ele alınmıştır. Müslüman olmadan önce Medine Yahudilerinin önemli ilim adamlarından biri olan Abdullah b. Selâm, Müslümanlar arasında da ilmî açıdan önemli bir yere sahip olmuştur. Sahâbîlerin ona sorular yönelterek onun eski dinine dair ilminden istifade ettikleri görülmektedir. Hatta Hz. Peygamber dahi bazı hususlarda onun Tevrat bilgisinden yararlanmıştır. Abdullah b. (...) Selâm, hakkında birtakım ayetler nazil olan, aynı zamanda pek çok ayetin tefsirinde de kendisinden bahsedilen bir sahâbîdir Kur’an’ın Yahudi kökenli oldu-ğuna dair iddialarda adının zikredilmesi de Abdullah b. Selâm’ı önemli bir isim kılmaktadır. Hadis rivayeti açısından bakıldığında Abdullah b. Selâm’ın yetmiş beş rivayeti tespit edilmiştir. Bu yetmiş beş rivayet içerik olarak incelendiğinde ise aslında bunların toplamda elli rivayetin farklı versiyonları olduğu görülmektedir. Bu rivayetler çerçevesinde Abdullah b. Selâm’dan rivayette bulunan elli râvî tespit edilmiştir. Bunlar içerisinde sahâbî, muhadram ve tâbînden olanlar bulunmaktadır. İsrâiliyat üzerinden eleştiriye maruz kalan Abdullah b. Selâm’ın mevkuf rivayetleri içerikleri itibariyle incelendiğinde İsrâiliyat konularıyla alakalı olabilecek yirmi iki tane mevkuf rivayeti olduğu görülmüştür. Bu rivayetlerin içeriği genel itibariyle yaratılış, peygamberler tarihi, ahiret ahvâli, kıyamet alametleri, fiten ve melâhîm ile alakalıdır. Bu tür rivayetlerinin miktarı göz önünde bulundurulduğunda aslında onun İsrâiliyat konusunda çok abartılacak bir etkisinin bulunmadığını söylemek mümkündür. (shrink)

Dans sa lecture de l'Hommage de Lacan à Marguerite Duras pour Le Ravissement de Lol V. Stein, Erik Porge met en évidence, cinquante ans après, l'actualité de ce texte où Lacan lie la problématique de la sublimation à celle d'une fiction clinique faisant cas. Il montre en effet que la transmission de la clinique de l'analyste participe de la dynamique de la sublimation de celui-ci. La topologie du fantasme, avec laquelle cette folie féminine - qui s'inscrit dans la suite de (...) Marguerite Anzieu (cas Aimée) et des soeurs Papin - est abordée, ouvre le lecteur à une dynamique transférentielle et de sublimation par son articulation à la pulsion. En même temps que Lacan parle de la sublimation, il est ravi par le texte et fait acte de sublimation dans l'écriture de son Hommage, en nouant l'objet de sa propre pulsion au Ravissement de Lol V. Stein et à Marguerite Duras elle-même. Dans un mouvement de retour sur sa lecture de ce texte, Lacan élève la lettre à la dignité de la Chose (définition de la sublimation) ; le style devient condition d'accès au cas et fait lui-même cas. Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Daniel M. Haybron Cet article présente une catégorie de conditions fonctionnelles pour aborder certaines difficultés qui ont surgi dans le travail philosophique sur la nature du bonheur. Dans des travaux antérieurs, j’ai défendu une théorie du bonheur comme état émotionnel selon laquelle être heureux consiste essentiellement en des états dispositionnels, tels que la propension à une humeur détendue ou ravie. Les conceptions hédonistes du bonheur, qui le réduisent à des expériences de plaisir, ont été rejetées en partie parce qu’elles semblent (...) commettre une erreur de catégorie. Cependant, la nature de cette erreur de catégorie est restée incertaine, et la dispositionnalité revendiquée du bonheur a également été contestée même par des commentateurs par ailleurs sympathiques à une théorie de l’état émotionnel. Ici, je réponds à ces inquiétudes en précisant les fondements métaphysiques de la conception de l’état émotionnel telle que je l’ai articulée. Comprendre le bonheur en termes de condition fonctionnelle d’un individu résout ces énigmes d’une manière qui aide à expliquer la signification distinctive du bonheur. (shrink)

Sa présence efficace ne prend pas l'aspect d'un accueil ostentatoire : elle se présente plutôt comme la découverte ravie d'une convergence inaperçue jusque-là. On « tombe d'accord » selon l'heureuse expression française, en s'émerveillant de cette entente inopinée que tout avait pourtant - Etudes japonaises.

When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration. Recent policy developments in the area of livestock husbandry have suggested that, from the perspective of optimizing animal welfare, new animal husbandry systems should be developed that provide opportunities for livestock animals to be raised in environments where they are permitted to engage in “natural behavior.” It is not known whether consumers regard animal husbandry issues as important, and whether they differentiate between animal husbandry and other animal welfare issues. The responsibility for the development of such systems is allocated jointly (...) between farmers, regulators, different actors in the food chain, and consumers. This research focuses on understanding consumer attitudes and preferences regarding the development and introduction of such systems, to ensure that they are acceptable to consumers as well as producers, regulators, and scientists. Consumer perceptions of animal welfare and animal husbandry practices were evaluated using quantitative consumer survey, which focused on two animal husbandry issues – farmed pigs and farmed fish. Following pilot work, 1000 representative Dutch consumers were sampled about their attitudes to either pig or fish husbandry. The results indicated that consumers think about animal welfare in terms of two broad categories related to their health and living environment, but do not think about welfare issues at a more detailed level. Greater concern was expressed about the welfare of pigs compared to fish. Consumer trust in labeling also emerged as an important issue, since consumers need to trust different food chain actors with responsibility for promoting animal welfare, and are reluctant to consider the details of animal husbandry systems. As a consequence, a transparent, enforceable, and traceable monitoring system for animal welfare friendly products is likely to be important for consumers. (shrink)

The study examines the relationship between the strength of an organizationÕs ethical climate and ethical problems involving human resource management. Data were collected through a survey of 1078 human resource managers. The results indicate a statistically significant negative relationship between the strength of an organization'ss ethical climate and the seriousness of ethical violations and a statistically significant positive relationship between an organization'ss ethical climate and success in responding to ethical issues. Thus, interventions that strengthen an organization'ss ethical climate may help (...) manage ethical behavior within organizations. (shrink)

We have arrived at an inflection point, a moment in history when the sentience, conscious- ness, intelligence, agency, and even the moral agency of many nonhuman animals can no longer be questioned without ignoring centuries of accumulated scientific knowledge. Nowhere is this more true than in our understanding of nonhuman primates (NHPs). A neu- roethics committed to probing the ethical implications of brain research must be able to respond to and anticipate the challenges ahead as brain projects globally prepare to (...) increase the use of NHPs in research. This requires adopting a less anthropocentric focus that includes nonhuman animals within its scope. But the Neuroethics Roadmap represents a missed opportunity to critically examine the future direction of research with NHPs in an ethically-responsive neuroscience. (shrink)

This book presents three of the works of Abdu'l-Bahá, son of the founder of the Bahá'i Faith, dealing with social and political issues.00In 'The Secret of Divine Civilization' (1875) Abdu'l-Bahá supports the administrative and broader social reforms of Mirzá Hosayn Khán, but looks mainly for organic reform through the efforts of Iranian intellectuals to waken and educate the masses. In this work, Abdu'l-Bahá gives virtuous and progressive Islamic clerics a leading role among these intellectuals, indeed most of his appeals are (...) directed specifically to them. 'A Traveller's Narrative' (1889/90) is an authoritative statement of the broad lines of Bahá'i social and political thinking. 'The Art of Governance' (1892/93) was written as Iran entered a pre-revolutionary phase, and ideas that we recognise today as the precursors of political Islam were spreading. It sets out the principles underlying the ideal relationship between religion and politics and between the government and the people.00In addition to presenting the first parallel text translations of these works, the Persian texts incorporate notes on variants in the early published sources. The attitude that ordinary language description of experience is in fact a description of the world is called “naïve realism.” There is an entire branch of modern Western philosophy that is devoted to critically examining the assumptions behind the everyday language we use to describe the macroscopic world in which we live and the validity of naïve realism as an adequate description of the world. This branch of philosophy is called “ordinary language philosophy.” Surprisingly, it has something in common with (...) quantum physics: insight into the inadequacy of ordinary language to describe observable reality. It is this connection between ordinary language philosophy and quantum physics that we shall explore in this article. In the process, we shall also offer a basic introduction to both basic philosophy and basic quantum theory. (shrink)

The phenomenon whereby severely disabled persons self-report a higher than expected level of subjective well-being is called the “disability paradox.” One explanation for the paradox among brain injury survivors is “response shift,” an adjustment of one’s values, expectations, and perspective in the aftermath of a life-altering, disabling injury. The high level of subjective well-being appears paradoxical when viewed from the perspective of the non-disabled, who presume that those with severe disabilities experience a quality of life so poor that it might (...) make their lives not worth living. This presumption has profound consequences, for it may inform end-of-life choices made in advance directives, or influence decisions made by surrogates on behalf of persons who are unable to direct their own medical treatment. -/- Peterson et al propose a cautious, well-considered plan to use fMRI-based brain-computer interfaces to assess the decision making capacity of covertly aware, behaviorally non-responsive individuals who retain high levels of preserved cognition. Their plan, if it succeeds, could eventually restore autonomy and empower some severely disabled persons, allowing them to participate in clinical decision making. Peterson et al discuss possible in-principle objections to their proposal, among them the “argument from psychological health,” and the “changing sets of values” objection. These objections both presume that deviations from a pre-injury norm could indicate diminished decision making capacity. This presumption threatens the autonomy of the patient who is capable of making decisions, but whose post-injury decisions appear to diverge from pre-injury preferences or values. In light of the potential for response shift, and the disability paradox, it should not be inferred that changes in values or preferences are unreflective of the true current preferences of a brain-injured person, nor are they conclusive evidence of diminished capacity. Presuming diminished capacity on the basis of unexpected or unconventional preferences has, in the past, been used to disempower patients whose autonomy and capacity would not have been doubted had they made choices that accorded with the expectations or values of others. We must be cautious, and vigilant, to prevent similarly diminishing the autonomy of covertly aware, behaviorally non-responsive individuals on the basis of empirically and ethically questionable inferences about their decision making capacity. The phenomenological method he defended is basically a hermeneutical approach in which an observer relates personally and even existentially to the “phenomena” (s)he studies in order to determine their essence (Wesensschau). In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. The publication of the article “Recent Models of the African Iron Age and the Cattle-Related Evidence” by Hromnik in a journal sponsored by Unesco raises a number of serious issues which we, as members of the International Scientific Committee charged with the responsibility of preparing an up-to-date and scientific history of Africa purged of its mists of racist propaganda, unfounded assertions and misleading and dangerous misinterpretations, cannot ignore. These issues include the scientific accuracy or authenticity of the article.

Pucelle tries to show how the idea of personal liberty is central to Green's ethics. Green's criticisms of other philosophers and the historical context of his philosophy are especially well handled. --W. L. M.
